Worker Classifications

Workers in Burkina Faso may be classified as full-time, or Executive (including Supervisors, Technicians, and similar staff) or Hourly paid Workers.

Fixed-Term Contracts

Fixed term contracts are permissible in Burkina Faso. The length of a fixed term contract for a local Worker has a maximum of 2 years. For foreign Workers, a fixed term contract has a maximum of 3 years. Fixed term contracts may not be renewed. Early termination of a fixed term contract for reasons other than gross misconduct will result in payment of the full term of the contract.

Probationary Periods

Probationary periods are permitted in Burkina Faso, the length of the probationary period is dependent upon the Worker’s Classification. For Hourly paid Workers, a probationary period may have a maximum of 8 days. For Workers other than Executives, a probationary period may have a maximum of one month. For Executives, the probationary period may be a maximum of three months. Workers terminated during their probationary period would be owed their pro-rated salary and any accrued vacation leave.

Holidays

There are 15 public holidays in Burkina Faso. Work on holidays is paid at 160% of the Worker’s regular wage. Holidays that fall on a Sunday are typically observed on the following Monday.
 
 

Vacation

Workers are entitled to 2.5 calendar days of paid vacation for each month of effective service, or approximately 30 calendar days annually.
 
 

Sick Leave

Workers are entitled to sick leave based on their length of service. Workers with less than 1 year of service are entitled to 1 month of sick leave at full pay, and 1 month of sick leave at half pay. Workers with between 1 and 5 years of service are entitled to 2 months of sick leave at full pay and 2 months of sick leave at half pay. Workers with between 6 and 10 years of service are entitled to 2 months of sick leave at full pay and 3 months at half pay.

Working Hours

A standard workweek is 8 hours per day and 40 hours per week. Workers must be provided a rest period of at least 11 hours within a 24-hour timeframe. Workers are entitled to a paid weekly rest period of at least 24 consecutive hours in every 7 day period in which they complete the full weekly hours. Night work may not exceed 7.5 hours per day or 11 hours per week.

Overtime

Overtime is any time worked over the standard working hours. The first eight hours of overtime are payable at 115%. After the first eight hours of overtime, time worked is compensable at 135%. Overtime work on Sundays or Holidays is compensated at 160%. Night time work on Sundays or Holidays is compensated at 220%.

Mandatory Bonuses

Workers are entitled to a 13th month salary at the end of the year.
 
 

Termination

Terminations must be filed with the labor office, in addition to providing the Worker with a termination notice. The notice required for workers terminated without just cause is dependent upon the Worker’s Classification. For Hourly Workers, notice of 8 days is required. For non-Executives a notice period of one month is required. For Executives, a notice period of three months is required. Payment in lieu of notice is not permissible. Severance pay is required for terminations that are not the fault of the Worker, such as a reduction in force. Severance pay is calculated at 25% of the Workers’ salary per year of service. Severance pay is not required when there is gross misconduct or when a fixed term contract naturally expires.

Resignation

Workers must provide the same notice period as required by the Company, and are not entitled to severance pay.
