Worker Classifications

There are no official subcategories of workers in Burundi.

Fixed-Term Contracts

​Fixed-term contracts should only be for work that is of short-term nature or work that cannot be sustained long-term. There are sectors and job categories where short-term employment is acceptable.

Probationary Periods

Probationary periods are permitted anywhere from 1-6 months. Termination during probation period is outlined in the notice period of employment agreement.

Holidays

There are 13 public holidays and they are fully paid. A double rate applies for overtime work with prior cconsent from an employee if overtime is required.

Vacation

Employees are entitlted to one and two-thrids days of vacation leave for each month employment with the company. This amounts to 20 days of paid annual leave. They also have a roght to a leave of absence after at least one month of working.

Sick Leave

Sick leave is 3 months (90 days) per year with pay at 100% for the first 3 days and 66.7% for the rest of the days up to 87 days.

Working Hours

The standard work week is 8 hours a day with a maximum of 45 hours a week. Hours can vary per day but should not exceed the weekly limit. Working week is standard 5 days. 6 days is allowed as long as the employee does not work more than 45 hours

Overtime

Maximum overtime a week is 15 hours and 150 hours annually. Overtime pay is 135% of the normal hourly rate for the first 2 overtime hours after 45 hours and 160% of the normal hourly rate beyond the 48th hour.

Mandatory Bonuses

There are no mandatory bonuses.

Termination

Either party can terminate a contract of indefinate by serving a notice or paying in lieu thereof. A fixed-term contract terminates at the end of its term or by cancellation by either of the parties or in the case of gross misconduct. Otherwise, termination by one party entitles the other party to damages. Either party can terminate an indefinite term employment contract by serving a notice or paying in lieu thereof. In the case of gross negligence, notice may not be required. Generally, notice period is fixed by collective agreement. Minimum length of notice period for termination of employment  contract by employer is: one month of less than 3 years, two months  3-5 years, three months for 5-10 years, four months for 5-10 years.
