Worker Classifications

There are no specific classifications of Worker's in Iraq.

Fixed-Term Contracts

Fixed term contracts in Iraq are typically only used for project based work and temporary positions, such as those covering another worker's leave. A fixed term contract may be extended once by mutual agreement. Fixed term contracts that are extended more than once will be considered indefinite under Iraqi law.

Probationary Periods

Probationary periods are commonly used in Iraq, and may not be more than three months. If utilizing a probationary period, it must be explicitly stated in the worker's contract. During the probationary period, workers may be terminated with at least seven days' notice.

Holidays

There are 8 public holidays in Iraq. Some of these holidays are multiple days in duration.
 
 

Vacation

After one year of continuous service, workers are entitled to 21 paid vacation days annually. Workers in hazardous jobs are entitled to 30 paid vacation days annually. An additional two days of paid vacation are provided to workers for every five years of service for the first ten years of service. Accrued but unused vacation days are paid out upon termination.

Sick Leave

Workers are entitled to up to 30 days of paid sick leave per year. Paid sick leave may be extended to 180 days, for sick leave that exceeds 30 days, the Labour and Social Security Directorate will provide the company with the appropriate wage for the worker. Medical certificates may be required to support the use of paid sick leave. Workers with children under the age of six may take unpaid sick leave for up to three days whenever one of their children is sick and needs their care.

Working Hours

Working hours may not exceed 8 hours per day, or 48 hours per week. Standard workweeks may not exceed 6 days per week. Work hours are reduced to 6 hours per day during Ramadan. Workers are entitled to a 30 to 60 minute break in-between their daily working hours, and a fully-paid continuous 24 hours of rest per week.

Overtime

Overtime is permitted, however total working hours in one day may not exceed 10. Overtime work is compensated at 150% of the worker's regular hourly wage. Night work, defined as work between the hours of 10:00pm and 6:00am is compensated at 200%. Workers may not work more than 40 hours of overtime in any 90 day period.

Mandatory Bonuses

There are no required mandatory bonuses in Iraq.
 
 

Termination

Except in cases of serious misconduct, written notice of termination must be provided to workers at least 30 days prior to the termination date. Companies must have a valid reason for termination, such as company liquidation, downsizing, or a worker's prolonged illness. Payment in lieu of notice may be provided, but is uncommon in Iraq. Except in cases of serious misconduct, when a worker is subject to a company driven termination, they are entitled to severance pay in the amount of two weeks per each year of service.

Resignation

Workers must provide written notice of resignation. The mandatory amount of notice for a resignation is 30 days. Workers who resign are not entitled to severance pay.
